Description

With vast legal knowledge and political experience, the Firm advises businesses and government on policy, legislation, and regulation. We also give our clients a voice in County and State Agencies as they seek legislative or policy change that aligns with their business strategy. In addition, our Firm has experience in assisting its clients to manage regulatory risk.

The Firm has in the past and present represented Clients in their engagement with Government officials, legislators, regulators and relevant third parties in the formation and execution of public policy. With the ever-changing nature of laws, regulations, and policies, our team seeks to identify the key policy areas of importance to our Clients and liaises with them to ensure compliance and engages the relevant officials to effect policy changes that align with our Clients’ strategy.

We have competent practitioners in the area of legislative drafting. The firm has contributed to the drafting of various pieces of legislation, including but not limited to advising on Parliamentary and Senate Bills, statutory enactment and the legislative process; among other legislative issues.

Our Managing Partner has chaired several Government Task Forces in Kenya on immigration and tourism. Most recently; The Government of Kenya Taskforce on Foreign Employment and Labour Migration, which prepared a report to regulate, license and supervise Kenyans working abroad as migrant workers.

The Firm has undertaken the following legal assignments, in this practice area, among others, in the last few years:

  1. Legal consultants for the Independent Electoral and Boundaries Commission (IEBC), providing consultancy services; for review and enactment of electoral laws, electoral management bodies and electoral processes as envisioned in the new Constitution. The laws include but are not limited to the following Statutes; Independent Electoral and Boundaries Commission Act of 2011, the Elections Act, 2011 and the Political Campaigns Finance Bill, 2011.
  2. Provision of legal advisory services to a Client with regards to their on-shore exploration of oil and gas in Kenya on a license from the Government and representing the Client in the negotiations with the Government for extension of the license and drafting of the production sharing agreement.
  3. Provision of legal advisory services to Kenya Power on the draft Energy Bill 2017 currently before Parliament. Advising the Client on the salient provisions of the Bill and drafting the necessary subsidiary regulations to accompany the Bill for consideration, before the same passes into law.
  4. Provision of legal services to an International Client with regard to the sale of their shares in a local subsidiary and more particularly liaising with various regulatory bodies in the area of financial markets with a view to procuring the necessary approvals and consents to enable our Client successfully complete the transaction.
  5. Provision of legal services to a Client with respect to registration as a Fund Manager and thereafter incorporation of a Fixed Income Fund and more particularly assisting the Client in their dealings with the relevant State Agencies and Regulators to facilitate successful registration and incorporation of their businesses in the Country.
